Terms and Conditions for The Business Vault 

These terms and conditions, in conjunction with our services agreement and any other formal written agreements between The Business Vault ABN 27 424 742 681 and the purchaser (CLIENT), constitute the entire agreement governing the consulting programs and online portal services.

Binding Agreement: These terms and conditions become binding upon your agreement to proceed with a program, utilisation of a program, or upon making any payment for a program.

1. Consulting Programs:

1.1 Program Delivery:

  • The Business Vault's programs are delivered online, face-to-face, via telephone, or a combination of these methods.

1.2 Program Descriptions:

  • Small Business 1 on 1 Consulting

  • Profit Pillars Kickstart Program

  • Action Takers Mastermind Program

  • VIP Coaching Day

  • 4-Week Mini Mastermind

  • Mini Retreat Weekends

  • Personalised Business Audit

  • Any programs where The Business Vault offers service

  • Masterclasses & Webinars

1.3 Program Inclusions and Access:

  • All programs provide access to an online portal containing resources, templates, workshops, and relevant materials during the program term.

1.4 Participation and Unused Components:

  • Program components are non-transferable and expire at the end of the term. Non-attendance at live sessions or workshops does not warrant a refund. If a recording is available, you will receive the recording in case you miss the live session.

1.5 Coaching vs. Therapy:

  • The programs offered are for business coaching purposes and do not serve as a substitute for counselling or therapy.
     

2. Services:

2.1 1:1 Business Consulting Sessions:

  • Sessions will be provided through agreed-upon methods and locations.

2.2 Utilisation of 1:1 Sessions:

  • All 1:1 sessions within the program term must be utilised. Unused sessions expire at the end of the term.

2.3 Rescheduling Sessions:

  • Rescheduling sessions requires 24 hours’ notice. Failure to reschedule within the program term may result in session expiry.
     

3. Online Portal:
 

3.1 Access:

  • Access to the online portal is granted throughout the program term and ends at the term's conclusion.

3.2 Login Security:

  • Login details must not be shared. Usage of login details across multiple IP addresses may result in termination of access without refund.

3.3 Content Changes:

  • Content within the online portal may be subject to change or substitution without notice.
     

4. Mentoring by Paige Freeman:
 

4.1 Guidance and Mentoring:

  • Paige Freeman offers guidance and mentoring within certain programs. This guidance is not to be misconstrued as professional legal or financial advice.

4.2 Scope of Mentoring:

  • Mentoring sessions provided by Paige Freeman are intended for guidance and support within the scope of business & life coaching. They do not constitute professional advice on legal, psychological, or financial matters.

4.3 Focus of Mentoring:

  • Mentoring provided by Paige Freeman serves as guidance and mentorship aimed at enhancing business strategies, mindset, and personal growth within the program scope.
     

5. Events and Retreats:
 

5.1 Event Offering:

  • The Business Vault may offer live events as part of your program, as an added bonus, or available for purchase separately.

5.2 Event Costs:

  • Travel, accommodation, catering, and incidentals for events are not included in the event costs unless specified in the advertising for the event.

5.3 Event Notification:

  • The time and location of an event will be notified to you when it becomes available, or as advertised.

5.4 Circumstances Beyond Control:

  • Where circumstances beyond The Business Vault's control intervene (e.g., COVID restrictions):

    • You may be entitled to receive a refund on a case-by-case basis.

    • If an event is offered as an added bonus, you will not be entitled to transfer your ticket or apply any event fee as a credit towards a future event or coaching services.

    • The Business Vault may postpone an event. Your ticket will be changed to the following scheduled date, or a credit will be applied for future events, or alternatively, you will receive the recording of the event if available.

    • The Business Vault may change the delivery format of an event (e.g., from live in-person to online). You will be notified of the new place of attendance.

    • If an event is cancelled or if you are unable to attend an event that goes ahead and it is not recorded, you may apply your event fee (excluding deposit) as a credit towards attendance at a future event, or for coaching services with The Business Vault, provided you use that credit within 12 months of the original event date.
       

6. Client Responsibilities:
 

6.1 Client Obligations:

  • It is your responsibility to schedule 1:1 sessions, make use of the online portal, and commit time to attend any live session or workshop to ensure you obtain the maximum benefit of the programs.

  • Provide true and correct details when setting up an account to access the online portal.

  • Keep your username and password secure and not share your login details with anyone else.

  • You are solely responsible and liable for any loss or damage arising out of the use of your login details or online access.

  • Immediately notify The Business Vault of any unauthorized use of your password or other breach of security.

  • Do not rent, lease, sell, transfer, redistribute, or make available your access to the online portal to any third party.

  • Do not use the online portal in a manner that could damage, disable, overburden, or impair the website or interfere with any party’s use and enjoyment of the online portal.

  • Do not hack into areas of the online portal that are not intentionally made available to you.

  • Do not use the online portal or programs for any purpose that is unlawful or prohibited by these terms and conditions.

  • Do not use the online portal or programs in a manner that could bring The Business Vault into disrepute.

  • You are responsible for your own physical, mental, and emotional wellbeing when using the programs or the online portal. Discontinuing use of the programs does not entitle you to a refund.

  • If you are under the care of a mental health professional, inform them of your decision to use the programs and check if you have the required capacity to participate fully.
     

7. Fees and Payment:
 

7.1 Payment Obligation:

  • You agree to pay the fees in full and on time whether or not you use or access all components of a program or all content of the online portal.

7.2 Payment Process:

  • If you sign up for programs via online links, you must make your first payment as part of that process. If paying by instalments, the subsequent payments will be due the same day of each successive month until paid in full.

7.3 Payment Methods:

  • Payment may be made via PayPal or credit/debit card, processed by Stripe.

7.4 Arrears and Suspension:

  • If you are in arrears with your payments, services and access to the online portal may be suspended until all fees are paid up to date. This does not change the timeframe of this agreement. Sessions and access to the online portal will still expire at the end of the term, and you will be liable for the full amount of the program.

7.5 Dishonoured Payments:

  • If any payment is dishonoured for any reason, you will be liable for dishonour fees. If money remains unpaid, you will also be liable for any costs and disbursements incurred in pursuing the debt, including legal costs and debt collection costs to the extent permissible under relevant legislation.
     

8. Refund Policy:
 

8.1 Consulting Services:

  • The Business Vault aims to provide personalized consulting services to help you grow your business. If you decide to withdraw from programs before the end of the term, no refund will be offered.

8.2 Events:

  • Due to the costs involved in setting up and securing locations for live events and retreats:

    • If the event format is changed, you will be expected to attend via the new format.

    • If the event is postponed or cancelled, or if the event goes ahead but you are unable to attend for any reason, you may apply your event fee as a credit toward attendance at a future event, or for coaching services, provided you use that credit within 18 months of the original event date.

    • You may transfer your ticket to someone else without cost, provided you inform The Business Vault at least 7 days before the event date.

8.3 Program Purchase:

  • When you purchase a program available through the online portal, you will have access to all the benefits of the program at the time of purchase. Even if you elect to pay by instalment, you are agreeing to pay for the whole of the program in full and will not receive a refund if you stop accessing the online portal sooner than the end of your term of access.
     

9. Termination:
 

9.1 Term Conclusion:

  • Services and access to the online portal will terminate at the end of the term.

9.2 Inability to Fulfill Services:

  • If The Business Vault is unable to fulfill all services included in your program, through no fault of its own and other than as a result of you missing a session, The Business Vault may terminate this agreement upon seven (7) days written notice to you, without providing reasons. In such a case, a refund will be issued for the proportion of fees relating to the balance of the term or services already delivered.

9.3 Non-compliance:

  • The Business Vault reserves the right to cancel, suspend, or change your access to the online portal or programs, without liability, if you do not comply with these terms and conditions or the services agreement.
     

By engaging in our programs, you agree to be bound by these terms and conditions.

Note: This document can be reviewed and updated periodically. All changes will be effective immediately upon posting on the website, and your continued use of the services constitutes acceptance of the changes.
